Regardless of the type of Membership, I understand that the only way to cancel my Membership is to abide by the RULES & REGULATIONS listed below with respect to Member’s Right To Cancel or Other Cancellations. If any fee due under this Agreement is not paid within seven (7) days of the date it is due, BSTRC may, at its option, terminate my Membership. I acknowledge that the RULES & REGULATIONS listed below may be changed from time to time at the sole discretion of BSTRC, with or without notice, and that I will abide by any such changes.
I, the undersigned, hereby request membership to BSTRC to participate in the sport of firearms shooting and the practice of firearms shooting skills. I am fully aware of the risks and danger involved in such activities, and that unanticipated and unexpected dangers may arise during such activities. I assume all risks of injury to my person and property that may be sustained in connection with any such activities, or related activities, on or about the BSTRC premises. I hereby, for myself and my heirs, representatives, administrators, successors and assigns, release, discharge and hold harmless Elk Ridge Shooting Sports, LLC (d/b/a Bristlecone Shooting, Training & Retail Center), its members, owners, directors, officers, agents, representatives and employees, and all other participants (collectively, “Elk Ridge”) in the stated activities from all damages, claims, demands, actions and causes of action of any sort whatsoever for injury sustained to me or to my property arising out of my participation in such activities, or related activities, due to any causes, including without limitation the negligence of Elk Ridge. Further, Elk Ridge shall not be responsible or liable to members or their guests for articles lost or stolen on the premises, nor for damage to any property of members r their guests, including without limitation automobiles or their contents belonging to members or their guest(s). I represent and certify that I am of lawful age and legally competent to sign this release and hold harmless agreement, and that I fully understand the terms and conditions of the facilities and activities provided by Elk Ridge. I certify that my participation is voluntary, and that I have read and fully understand this entire agreement, including the RULES & REGULATIONS below.
RULES & REGULATIONS
Nature of Membership: Membership does not confer or carry with it any interest in the property or assets of Elk Ridge Shooting Sports, LLC (hereinafter referred to as the Company), or any right on the part of the members to participate in the operation or management of the Company, or any facilities operated by the Company, financially or otherwise. Membership hereunder confers solely the right to use and enjoy the facilities in accordance with these Rules & Regulations, as they may change from time to time.
Conditions of Membership: Membership is open to any person, or other legal entity (corporation, limited liability company, partnership, etc.) in the case of a corporate Membership, of good character and responsible credit background, without regard to race, sex, ethnic background, religion, or sexual orientation of the persons, or persons comprising such entity, including without limitation, its employees. All applications for Membership are subject to approval by the Company, which shall have discretion to approve or reject applicants for any reason whatsoever. All members shall be subject to these Rules & Regulations, and any Range Rules (as posted in store and/or online on the www.bristleconeshooting.com website, or any other website of the Company), incorporated herein by this reference, as the same may change from time to time.
Dues and Charges:. Annual Memberships (paid in advance) have no additional monthly payments. These Annual Memberships expire twelve (12) months after purchase and must be renewed by the member. Monthly Recurring Memberships are billed on a recurring basis with no predetermined expiration date. By purchasing a Monthly Recurring Membership, you are authorizing Bristlecone Shooting, Training & Retail Center to charge your credit card in the amount indicated above each month on the anniversary date of the initial Membership dues payment (unless otherwise noted). In the event of non-payment of monthly membership dues for a period of seven (7) days, you will be notified via email and your membership will be suspended for seven (7) days to allow you to correct the billing issue. If the issue is not resolved within seven (7) days after the notice, your Membership will be terminated and you will be responsible for any uncollected membership fees. Once terminated, you will be required to pay the associated Initiation Fee to re-establish your Membership. Initiation fees are not refundable for any reason. Repairs and maintenance may make it necessary for the Company to restrict the use of, or close, one or more portions of the range, and the Company may do so at any time, without prior notice. In the event that any portion of the facility (including one or more shooting lanes in the range) is unavailable, for any reason, monthly dues will not be reduced, suspended or pro-rated during such period. Use of the shooting range is on a first come first served basis, except in the event of a member lane reservation, in which event the Company will make every effort to accommodate such reservation, but cannot guarantee any particular lane or time period.
Transferability: Memberships may not be sold or transferred.
Waiver of Claims: It is expressly agreed that all use of any of the Company’s facilities (including those provided by the Company at the Range) shall be undertaken by a member or guest at his/her sole risk, and the Company shall not be liable for any injuries or any damage to any member or guest, or the property of any member or guest, or be subject to any claim, demand, action, cause of action, injury or damages whatsoever. The member, for himself/herself and on behalf of his/her executors, administrator, heirs, assigns and successors does hereby expressly forever release and discharge, and hold harmless the Company, its members, owners, shareholders, officers, employees, agents, assigns and successors from all such claims, demands, actions, causes of action, injuries, or damages. The Company shall not be responsible for or liable to members or their guests for articles damaged, lost or stolen in or about the facility (including locks to, or contents of lockers) or for loss or damage to any property of members or guests, including but not limited to automobiles and the contents therein.
Involuntary Resignation and Suspension: The Company reserves the right at any time to terminate or suspend any Membership, or the privileges afforded thereunder, for such period of time as it shall deem appropriate for failure to comply with any of these Rules & Regulations, any posted Range Rules, or for any conduct determined to be improper or in any way contrary to the best interest of the Company. Any membership may be terminated by notification in writing via email to the email address on file for the member being terminated or mailed by the Company to the last address shown on the records for the member being terminated, and such termination shall be effective three (3) days after transmission of such notice, regardless of actual receipt by the member whose membership is being terminated. Regardless of a Membership termination, a terminated member will remain liable for all dues and other indebtedness incurred prior to delivery of the Membership termination notice by the Company. At the sole and absolute discretion of the Company, the Membership of any member who shall allow their Membership dues to fall in arrears by more than seven (7) days may be suspended or terminated. Reinstatement of Membership will require payment in full of all past due amounts, late fees and Initiation Fees, as the case may be, and will result in the loss of any “Charter” Membership status.
Registration: Members must check in at the range counter every time they use the facilities provided by the Company. Members failing to present a Membership number (or proper Membership ID) will be denied member status and will be deemed a guest.
Guests: Guests must check in at the range counter every time they use the facilities provided by the Company. Members are responsible for the conduct and safety of their guests. The Company reserves the right to limit the guests a member may bring to the facilities at any one time. Rules regarding guests may be subject to change at the discretion of the Company.
Training: No outside paid instructors are permitted to instruct at the Bristlecone facility. All paid instruction will be provided by Bristlecone personnel.
Attire: Proper attire is required. The Company reserves the right, in its sole and absolute discretion, to deny admittance to the facility or the Range to anyone at any time based on attire. Required attire includes closed toe shoes and high neckline shirts. Flip-flops and/or sandals are not permitted in the Range. Eye and ear protection is mandatory for the protection of all members and guests using the Range. For special courses, a baseball style cap may be recommended.
Damages: Each member shall be responsible for any damage to BSTRC property caused by themselves or their guest(s).
Hours: Bristlecone Shooting, Training & Retail Center hours will be posted at the facility.
Use of the Range by Juniors: Anyone under the age of 18 must be accompanied by a legal guardian at all times on the Range, when handling firearms in our retail section, or when using the virtual training simulator. Our guests aged 18-20 are welcome to use long guns on our range, but must be accompanied by someone 21 or over to use handguns. The Company is not permitted to rent handguns to anyone under the age of 21. Children under the age of 10 are not permitted to shoot on the Range, but when accompanied by a legal guardian, are more than welcome to explore firearms in our retail area and use the virtual training simulator.
Food and Beverages: Food and drinks may be consumed in the retail area, cafe area or classrooms only, but are NOT allowed in the Range.
Smoking: Smoking is not allowed at any time anywhere inside the building, or within 25 feet of the entrance to the building. Smoking is permitted outside the building in designated areas only. Please be considerate and dispose of all smoking materials in the provided receptacles.
Admittance: The Company reserves the right, in its sole and absolute discretion, to deny admittance to the facility or the Range to anyone at any time for any reason whatsoever.
Cancellation: Bristlecone requires thirty (30) days advance written notice to cancel a Monthly Recurring Membership. Cancellation notices can be emailed to Info@BristleconeShooting.com or physically delivered to 12105 W. Cedar Dr. Lakewood, CO 80228. Initiation fees are non-refundable. This Agreement may be canceled for a partial refund of annual or monthly dues ONLY in the following circumstances: (A) the member dies or becomes totally disabled, and the member or a representative provides the Company with confirmation thereof (from a physician in the case of total disability); or (B) the member moves to a new permanent residence more than 100 miles from the facility. Reasonable evidence of relocation is required.
Changes: Annual dues, these Rules & Regulations, and the Range Rules are subject to change by the Company from time to time without notice. The Company will make a good faith effort to notify members of such changes, but shall not be liable for failure to do so. Members may be notified of such changes in any manner which the Company feels necessary, including but not limited to verbal, and posting onsite or on the Company website.
